Welcome to ApplyInterview. These Terms and Conditions ("Terms") govern your access to and use of the ApplyInterview website and services (collectively, the "Service"). By creating an account, paying for, or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Service.

1. Service Description

1.1. ApplyInterview is a service designed to assist users ("you," "the User") in their job search. The Service includes, but is not limited to:

Scanning job boards and career sites for suitable job opportunities based on your criteria
Using your information to generate and submit job applications on your behalf
Managing your interview schedule and communications
Providing updates and communications related to your job search process

1.2. No Guarantee of Success. You acknowledge that ApplyInterview is a tool to assist your job search. We do not and cannot guarantee that you will receive job interviews, job offers, or employment. The success of an application depends on numerous factors beyond our control, including your qualifications, market conditions, and the decisions of potential employers.

2. User Account and Responsibilities

2.1. Eligibility. You must be at least 18 years old and of legal age to form a binding contract in your jurisdiction to use the Service.

2.2. Account Creation. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. This includes your resume/CV, contact details, job preferences, salary expectations, and work history.

2.3. Accuracy of Information. The quality and success of the applications submitted on your behalf are directly dependent on the accuracy and quality of the information you provide. You are solely responsible for any errors, omissions, or inaccuracies in the information you submit to the Service.

2.4. Authorization. By using the Service, you expressly authorize ApplyInterview to act as your agent for the limited purpose of searching for and applying to jobs on your behalf. This includes:

Creating accounts on job boards if necessary
Submitting your personal data, resume, and other provided information to potential employers and recruitment agencies
Communicating with potential employers on your behalf for the purposes of scheduling interviews

2.5. Account Security. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Fees, Billing, and Cancellation

3.1. Fees. The Service is subject to a one-time Setup Fee and a recurring monthly subscription Fee, as detailed on our pricing page. All fees are quoted in British Pounds (£) and are inclusive of any applicable VAT.

3.2. Setup Fee. The Setup Fee is a one-time, non-refundable charge that covers the initial profile analysis and system configuration for your account. It is charged upon signing up for the Service.

3.3. Subscription Billing. The monthly subscription Fee is billed in advance on a recurring monthly basis. Your subscription will automatically renew each month unless you pause or cancel your account.

3.4. Payment. We use Stripe to handle all payments. We do not store your credit card details. You agree to be bound by the terms and conditions of our payment processor.

3.5. Pausing Your Subscription. You may pause your subscription at any time by contacting our customer support team. When paused, we will cease all application activities, and you will not be billed for subsequent months until you choose to reactivate your subscription. No refunds or credits will be issued for partial months.

3.6. Cancellation. You may cancel your subscription at any time. Cancellation will be effective at the end of your current billing period. You will retain access to the Service until that date. No refunds will be provided for the Setup Fee or for any unused portion of your subscription term.

4. Intellectual Property

4.1. Our IP. All rights, title, and interest in and to the Service, including the website, our logos, and all other software and materials, are and will remain the exclusive property of ApplyInterview and its licensors.

4.2. Your Content. You retain all ownership rights to the content you submit to the Service, such as your resume/CV and personal information ("User Content"). By submitting User Content, you grant ApplyInterview a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, prepare derivative works of, distribute, and display your User Content solely for the purpose of providing and improving the Service.

5. Confidentiality and Discretion

5.1. We understand the sensitive nature of a job search. We will take commercially reasonable steps to maintain the confidentiality of your job search.

5.2. Exclusion of Current Employer. If you provide us with the name of your current employer, we will use reasonable efforts to configure our service to not submit applications to that specific company. However, due to the nature of automated systems and complex corporate structures (e.g., parent companies, subsidiaries), we cannot provide an absolute guarantee. You are responsible for providing the correct and complete legal name of any company you wish to exclude.

6. Limitation of Liability

6.1. "AS IS" Service. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, APPLYINTERVIEW, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF THE SERVICE, THIRD-PARTY WEBSITES, OR THE OUTCOME OF ANY APPLICATIONS.

6.2. Limitation. IN NO EVENT SHALL APPLYINTERVIEW BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6.3. Cap on Liability. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE GREATER OF (A) THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE THREE (3) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING, OR (B) ONE HUNDRED BRITISH POUNDS (£100).

7. Indemnification

You agree to defend, indemnify, and hold harmless ApplyInterview, its subsidiaries, affiliates, and their respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your User Content; (2) your use of the Service; (3) your breach of these Terms; or (4) your violation of the rights of a third party, including but not limited to the terms of service of any job board.

8. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.

9. General

9.1. Changes to Terms. We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

9.2. Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and ApplyInterview regarding the use of the Service.
